Quelite Jewels Limited (“we,” “us,” “our”) operates quelitejewels.com (“Website”). These Terms & Conditions (“Terms”) form a legally binding agreement between you (“you,” “customer”) and Quelite Jewels Limited, a company incorporated in Hong Kong (Registration No. 41481920).

By accessing the Website, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must cease using the Website immediately.

## 1. General Use of the Website

### 1.1 Eligibility
– You must be at least 18 years of age and have full legal capacity to enter into contracts.
– By using the Website, you represent and warrant that you meet these requirements.
– We reserve the right to request proof of age or identity.

### 1.2 Account Registration & Accuracy of Information
– You agree to provide true, accurate, current, and complete information during registration, checkout, or communication.
– You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

### 1.3 Prohibited Activities
You must not:
– Use the Website for any unlawful, fraudulent, or harmful purpose
– Infringe intellectual property rights (e.g., copying designs, text, or images)

– Engage in spamming, phishing, or data scraping

Violation may result in immediate account termination and legal action.

## 2. Products & Orders

### 2.1 Product Descriptions & Specifications
– All jewelry features *synthetic / lab-created diamonds* (not natural/mined) certified by IGI, or equivalent unless otherwise stated. All diamonds are conflict-free and ethically sourced.
– We make every effort to ensure accuracy in:
– Carat weight, cut, color, clarity (4Cs)
– Metal type (e.g., 18K gold, platinum)
– Dimensions and design details
– Minor variations may occur due to:
– Handcrafting
– Photography lighting
– Screen calibration

### 2.2 Pricing & Currency
– Prices are displayed in Australian Dollars (AUD), US Dollars (USD), or Hong Kong Dollars (HKD) as selected.
– Prices exclude shipping, insurance, and applicable duties/taxes unless *DDP option is selected*.
– We reserve the right to adjust prices without prior notice, except for:
– Orders already confirmed and paid in full
– Typographical errors: If a price is clearly incorrect, we may cancel the order and issue a full refund.

### 2.3 Order Placement & Acceptance
– Placing an order constitutes an offer to purchase.
– We may accept or reject your offer at our sole discretion.
– An order is confirmed only upon email receipt of:
– Order confirmation
– Payment authorization
– We may cancel orders due to:
– Stock unavailability
– Pricing errors
– Suspected fraud
– Customs restrictions
– Full refund issued within 7 business days if canceled.

### 2.4 Customized & Made-to-Order Jewelry
– Includes engraving, resizing, or bespoke designs.
– Non-cancellable and non-returnable once production begins (typically within 48 hours).
– Subject to Section 6 if defective.

## 3. Payment

### 3.1 Accepted Payment Methods
– Credit/Debit Cards (Visa, Mastercard, Amex)
– PayPal
– Other methods displayed at checkout
– You warrant that you are authorized to use the selected method.

### 3.2 Payment Processing & Security
– Processed via PCI-DSS compliant gateways (e.g., Stripe, PayPal).
– We use 256-bit SSL encryption.
– We do not store full card numbers post-transaction.

### 3.3 Currency Conversion & Bank Fees
– Transactions charged in selected currency.
– You are solely responsible for:
– Currency conversion fees
– International transaction fees

### 3.4 Failed Payments
– If payment fails, your order will be held for 48 hours.
– We may cancel the order if payment is not completed.

## 4. Shipping & Delivery

### 4.1 Origin & Carriers
– All orders ship from Hong Kong via:
– DHL Express
– FedEx International Priority

### 4.2 Processing Time (7–14 Business Days)
Includes:
1. Payment verification (1–2 days)
2. Diamond sourcing & grading (2–4 days)
3. Crafting & setting (3–5 days)
4. Quality control & certification (1–2 days)
5. Secure packaging with IGI certs (1 day)

>Business days exclude HK public holidays.

>Delays possible during peak seasons or customs holds or high courier volume.

### 4.4 Tracking & Insurance
– Full tracking provided via email.
– Insured up to declared value during transit.

### 4.5 Risk of Loss & Title
– Title and risk transfer to you upon handover to the carrier.

## 5. Taxes, Duties & Customs

### 5.1 Hong Kong Export
>No Hong Kong taxes, GST, or export duties apply.

### 5.2 Shipping Terms: DDU (Delivered Duty Unpaid) – Default Option
>All international orders use DDU unless you select DDP at checkout.
– Under *DDU*, prices **exclude all import duties, GST/VAT/HST/sales tax, brokerage fees, or handling charges.
– These fees are:
– *Determined by your local customs authority* based on the item’s declared value, HS code, and origin (Hong Kong).
– *Collected directly by the courier* (e.g., DHL, FedEx) *at delivery* before releasing your parcel.
– *Mandatory* to receive your order.
– *You are solely responsible* for payment. We have *no control* over amounts.
– *For lab-grown diamond jewellery (HS Code: 7113.19)*:
– 🇦🇺 *Australia*: 5% customs duty on the goods value + 10% GST (calucated on the total of goods value + duty + shipping + insurance) + courier handling free (~AUD 20–50).

*Total Estimated additional costs: 15–20% of order value*.

*Note: if the customs value of consignment is AUD 1,000 or less, duty and GST may be exempt. We recommend checking the the latest rates at https://www.abf.gov.au/importing-exporting-and-manufacturing/tariff-classification
– 🇨🇦 *Canada*: Orders may be subject to **5–15% GST/HST** + **0–5% customs duty* on jewellery under HS Code 7113.19

– 🇬🇧 *United Kingdom* Orders may be subject to • 20% VAT on the customs value (goods + shipping + insurance); and around 2.5–5% customs duty for jewellery under HS Code 7113.19; plus a customs clearance / handling fee charged by the courier (typically £15–30).

– 🇺🇸 *United States* Orders may be subject to State and local sales/use taxes (rate vary from 0-10% depending on the delivery state ans local rules); and 2.5-5.6% customs duty for jewellery under HD Code 7113.19; plus a customs brokerage/handling fee charged by the curier(US$20-50)

*Total estimated additional costs: usually 5-15% of the order value, depending on the destination state.*

*Formal entry required for shipments valued over US$2500
– *We declare accurate value and HS code* to ensure smooth clearance.

### 5.3 DDP Option – All Duties & Taxes Pre-Paid (Optional Upgrade)
>Available at checkout for select destinations (e.g., Australia).
– Select “Express Shipping – All duties included (DDP)”.
– We *pre-calculate and pay* all estimated import duties, taxes, and fees.
– *Benefits*: No surprise fees; faster clearance.
– *Higher shipping cost* reflects pre-paid amounts.
– *Non-refundable*: Duties paid to authorities cannot be reclaimed.

## 6. Returns, Refunds & Exchanges

### 6.2 Faulty Items
– Free repair/replacement/refund for defects.

### 6.3 Non-Returnable
– Customized, sale items, used/damaged goods.

## 7. Australian Consumer Law (ACL)
Australian customers have non-excludable ACL rights (acceptable quality, match description). These override conflicting terms. Disputes:https://www.accc.gov.au/

## 8. Limitation of Liability
– Liability limited to purchase price.
– No liability for indirect damages or courier/customs issues.

Governed by Hong Kong law. ACL applies to Australian customers.
